Be kind to the birds and to each other.

These are the terms of use for GardenBirbs. They are written in plain words. Last updated 6 October 2026.

Who these terms are between

GardenBirbs is made by AIntelligent Technologies Ltd, in Derbyshire, United Kingdom ("we", "us"). These terms are between you and us. By using the app or this website you agree to them. If you do not agree, please do not use them.

Who can use what

The journal on your phone is for anyone. A child may use it with an adult looking after them. It stays on the phone unless you share an entry or your phone’s own backup includes it.

You must be 18 or over to make an account and to share anything publicly. The first time you share something, we ask you to confirm that you are 18 or over. If you are not, please do not make an account or share. We do not ask anyone their age, so we rely on you telling us the truth.

Your account

You can sign in with an email code, and on iPhone, Sign in with Apple. Keep your sign-in safe. You are responsible for what is done through your account. Tell us at once if you think someone else has got into it.

You can delete your account at any time. How is on the delete account page.

Community rules

Sharing is for birds and gardens. What you share can be seen by other people who use the app, with only a rounded area shown, so please keep it kind and keep it safe. Do not share:

  • people as the main subject of a photo, nudity or sexual content
  • anything that identifies a child, contact details, or an exact address
  • the exact place of a nest, or anything that disturbs an active nest
  • anything that harms wildlife, or advice on traps or poaching
  • the real-time location of a rare or protected bird, or anything that makes a household easy to identify
  • threats, harassment, hate, impersonation, scams or anything illegal
  • anything you do not have the right to share

Please do not put the name of a child in a quote or a note.

Reporting and removal

On any post or garden you can report it, choosing one reason: child safety or privacy, an exact sensitive location, wildlife harm, harassment or hate, sexual or violent content, spam or a scam, or copyright and anything else. The person you report is not told who you are. You can also block a garden. Nobody is told you did.

We may hide or remove content, restrict an account or close it if these rules are broken or if the law requires it. We read reports as soon as we can and look at the most serious ones first, but we cannot promise an outcome or a time. If you think we were wrong, write to us.

You can remove anything you shared, and take down your garden, whenever you like.

What you share, and what we may do with it

What you share stays yours. When you share something you give us permission, free of charge and everywhere in the world, to store it and show it in the app to other people, for as long as it is shared. When you remove something, it stops being shown to other people, and we keep it out of view for appeals and abuse prevention until you delete your account. When you delete your account, we delete what you shared, apart from reports and moderation records we must keep for safety or the law. Only share what you have the right to share.

What is ours, and what is not

The app, this website, the drawings of the birds and the words are ours or used with permission. You may use the app for yourself. Please do not copy it, take it apart or reuse the drawings.

Reference bird calls come from Xeno-canto, which credits each recording to its recordist under its own licence. Bird names follow the Clements checklist (the eBird taxonomy) and the BOU British List. They are theirs.

Using the app properly

Please do not misuse the app: no scraping, no breaking in, no fake accounts, no overloading it, and nothing that is against the law. Watch birds from a distance that does not disturb them. The app is not a reason to go near a nest.

What we can and cannot promise

The app is free. We take care over it, but it is a journal and a guide, not a source of expert advice, and bird information may be wrong or out of date. We do not promise that it will always work, or that it will never lose anything. Keep a copy of anything you cannot do without.

Nothing in these terms limits what the law does not let us limit. That includes liability for death or personal injury caused by our negligence, for fraud, and your rights as a consumer. Subject to that, we are not liable for loss that was not a foreseeable result of our breach, for loss of data you did not back up, or for business loss, since this is a consumer app. Our total liability to you for anything connected with the app is limited to £100.

Ending things

You can stop using the app at any time. We may stop or change the app or an account if you break these terms or the law, or if we must, and where we can we will tell you why.

Changes to these terms

We may change these terms. The current version is always on this page. If you keep using the app after a change, you accept the new terms.

The law that applies

These terms are governed by the law of England and Wales, and its courts can hear any dispute. If you live in Scotland or Northern Ireland you may also bring a claim in your local courts, and if you are a consumer you keep the rights you have by law where you live.
